Request for Environmental Information – Padden Brook (SK6) Woodland / W1 Site

Dear FOI / Information Governance Officer,

I am writing to make a request for environmental information under the Environmental Information Regulations 2004 (EIR).

Site / Subject: The woodland and water-course area around Padden Brook, SK6 (including any W1-designated woodland or ancient/semi-natural woodland status, amenity land, SBI).

Information requested:

  1. Confirmation of whether the landowner or responsible party has been formally notified of the site’s protected status (for example: W1 designation, ancient woodland status, or other relevant restriction) in relation to this area.
  2. Any records of planning permissions, tree/woodland work licences (including from the Forestry Commission or equivalent), felling licences, or other environmental permits that have been issued, applied for, refused, or are under consideration for this site.
  3. Any records of enforcement notices, investigations, site inspections, or communication from the Council (or relevant authority) directed to the landowner/responsible party about works, clearance, or management of the woodland/waterway at this location.
  4. A statement of the legal protections or designations currently in force for this land/watercourse (e.g., W1 designation, woodland TPO, SBI, conservation area, etc.).

Reasoning / Public Interest Statement:
This request is made in the public interest in relation to the protection of the natural environment and biodiversity. The information sought concerns the management and potential harm to a woodland and water-course ecosystem, and the legal/administrative safeguards applicable to it. Under the EIR, such environmental information is generally disclosable as it pertains to factors, such as land management, habitat protection, and public interest in transparency. I understand that personal data or internal deliberations may be exempt, but the information requested – regarding notifications, permissions, designations and enforcement activity – is not confidential per se and falls within the scope of environmental information, and therefore should be disclosed unless a valid exception applies.
