I am requesting information under the Environmental Information Regulations 2004 (EIR) in relation to:

Land at Magda Road, Magda Road, Stockport, SK2 7LX
and associated reference DC/027600 (refused LDC dated 5 September 2007)


Information Requested

Please provide copies of all environmental information held by the Council relating to:

  1. Enforcement history
    • Whether any enforcement investigations, complaints, or case files have ever been opened in relation to the land
    • Whether any enforcement notices (formal or informal) have ever been issued
    • Any records confirming whether the Council considered the stationing, fencing, or use of the land to be unlawful development at any time
  2. Planning control decisions
    • Any records confirming the Council’s position on whether the land constitutes:
      • residential curtilage, or
      • a separate planning unit, or
      • previously developed (brownfield) land
  3. Site status after 2007
    • Any later planning permissions, refusals, appeals, or Lawful Development Certificates affecting the land
    • Any internal updates or reassessments of the site’s planning status since the 2007 refusal
  4. Evidence used in decision-making
    • Any aerial photography, site visit notes, or internal planning/enforcement notes relied upon in determining the site’s status

Clarification

This request is made to establish whether the Council has ever considered or taken action on any alleged breach of planning control or unlawful development at this site, and how the land’s planning status has been recorded over time.

The decision notice on DC/027600 visible online confirms the Council considered the land to  form part of the curtilage of 235 Dialstone Lane.  

  1. residential curtilage, or
  2. a separate planning unit, or
  3. previously developed (brownfield) land
  4. Site status after 2007
    • Any later planning permissions, refusals, appeals, or Lawful Development Certificates affecting the land

Planning Permission DC/042229 granted 7/8/2009.  Proposed three bedroom and roofspace room dwelling and detached single garage. Location is Land Rear Of 235 Dialstone Lane, Offerton, Stockport SK2 7LF

  1. Any internal updates or reassessments of the site’s planning status since the 2007 refusal

Following the grant (and implementation) of planning permission in 2009, the land has a lawful use as per DC/042229

  1. Evidence used in decision-making
    • Any aerial photography, site visit notes, or internal planning/enforcement notes relied upon in determining the site’s status

Information held by the Council relevant to this request is already publicly available via the Council’s planning website, including the original planning application and decision notice.
