Subject: Freedom of Information/EIR Request– Padden Brook, SK6 – sent 30th September 2025

Dear Council FOI Officer / Peter Pollard

Mr Pollard has stated: The original woodland order was intended to protect the woodland, which it has successfully done since it was created”.

·  A woodland TPO protects all trees within the mapped boundary, not just individual specimens.

·  Unlike an “area” TPO (which only protects trees that existed when the order was made), a woodland TPO applies to successor trees too — meaning natural regeneration is also protected.

·  To cut down or carry out work on trees in such a woodland, the landowner must apply for permission from the local planning authority.

I am writing to request information under the Freedom of Information Act 2000 regarding the woodland and Local Wildlife Site at Padden Brook, SK6 which has now been  in part destroyed.

Liz Sykes says such questions are vexatious, which makes me wonder if she is a fit person to hold this position.

Specifically, I would like to know:

  1. Tree Preservation Orders (TPOs) / Woodland Orders
    1. Was the site or any part of it subject to a Tree Preservation Order or Woodland Protection Order?
    1. If so, please provide copies of the relevant orders, and details of any applications or permissions granted for tree felling, clearance, or development affecting the site.
    1. If such orders were revoked, please provide the dates and reasons.
  2. Local Wildlife Site (LWS) designation
    1. Please provide information on when the site was designated as a Local Wildlife Site (or equivalent designation used by the authority at the time).
    1. Copies of any assessment reports, reviews, or surveys undertaken on the site since the 1960s.
    1. The date and reason for any change in its designation or status.
  3. Planning Permissions / Consents
    1. Copies of all planning applications and permissions granted for the site since the 1960s, including any conditions relating to ecology, tree protection, or biodiversity.
    1. Details of any enforcement actions taken, or considered, relating to tree felling or habitat loss on the site.

Please provide the information electronically (PDF or Word format is fine).

Yours faithfully,

Sheila Oliver
